1. Acceptance of Terms

By accessing or using Discovery Quest ("the Platform"), a product of Innolife Technologies (6751 N. Sunset Blvd., #320, Glendale, AZ 85305), operated through Edusparkteaching.com ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms apply to all users, including teachers, school administrators, students, and any other visitors.

2. Description of Service

Discovery Quest is an educational gaming platform designed for students in grades 5–8. The Platform provides interactive games, reading comprehension challenges, math fluency activities, vocabulary exercises, and critical thinking puzzles intended to supplement classroom instruction. The Platform is provided for educational purposes only.

3. Eligibility & Account Registration

• Discovery Quest is intended for use by educators and students in a school or educational setting.
• Users under the age of 13 must have verifiable consent from a parent, guardian, or school before using the Platform.
• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Teacher & School Responsibilities

Teachers and school administrators who use Discovery Quest with students agree to:

• Obtain appropriate parental or institutional consent before allowing student access to the Platform.
• Supervise student use of the Platform in accordance with school policies.
• Ensure students use the Platform only for its intended educational purposes.
• Take responsibility for any content they create, upload, or share through the Platform.
• Comply with applicable laws including FERPA, COPPA, and any applicable state student privacy laws.

5. Acceptable Use

You agree NOT to use Discovery Quest to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Impersonate any person or entity or falsely represent your affiliation with any person or entity.
• Attempt to gain unauthorized access to any portion of the Platform or any systems connected to it.
• Interfere with or disrupt the integrity or performance of the Platform.
• Use automated means (bots, scrapers) to access the Platform or collect data.
• Reverse engineer, decompile, or disassemble any part of the Platform.
• Use the Platform for any commercial purpose without our prior written consent.

6. Intellectual Property

All content, features, and functionality on Discovery Quest — including but not limited to text, graphics, logos, game mechanics, educational content, and software — are the exclusive property of Edusparkteaching.com and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for educational purposes only. You may not reproduce, distribute, modify, create derivative works of, or publicly display any content from the Platform without our prior written permission.

Content created by teachers (passages, vocabulary sets, questions) remains the intellectual property of the creating teacher. By uploading content, you grant us a license to store and display that content within the Platform.

7. AI-Generated Content

Discovery Quest uses artificial intelligence to generate educational content, including questions, passages, vocabulary definitions, and game content. While we strive for accuracy, AI-generated content may occasionally contain errors or inaccuracies. We do not guarantee the accuracy, completeness, or educational suitability of AI-generated content. Teachers are encouraged to review AI-generated content before using it with students. We are not responsible for any outcomes resulting from reliance on AI-generated content.

8. Privacy

Your use of Discovery Quest is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

9. Disclaimer of Warranties

Discovery Quest is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Edusparkteaching.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of educational progress, or loss of goodwill, arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.

11. Termination

We reserve the right to suspend or terminate your access to Discovery Quest at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason. Upon termination, your right to use the Platform will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Arizona.
